1. Acceptance of Terms

By accessing and using the Tour Mobility Rentals platform ("the Service"), the renter (“You”) agrees to be bound by these Terms of Use, as well as any other policies referenced herein and/or available by hyperlink. If you do not agree to these terms, you must not access or use the Service.

2. Service Overview

Tour Mobility Rentals offers rentals of electric scooters, strollers, and cribs ("the Rentals") to users through its website and mobile application ("the Platform"). The availability of each item is subject to demand, and all Rentals must be used in compliance with these Terms. Our store is hosted by Bookable.com (Salad Days B.V). They provide us with the online e-commerce platform that allows us to sell our products and services to you.

3. Eligibility

By agreeing to these Terms of Use, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
A breach or violation of any of the Terms will result in an immediate termination of your Services.

4. Rental and Usage Policies

4.1. Rental Period

The rental period begins when the item (scooter, stroller, or crib) is delivered to the requested address and ends when it is properly returned in accordance with the instructions provided. Users must ensure that the item is returned in designated areas or as instructed by the Platform.

4.2. Usage Rules

While using the Rentals, you must:

  • Operate the electric scooter safely, following all traffic laws and local regulations.
  • Use strollers and cribs in a safe and appropriate manner.
  • Not exceed the weight limit of the Rentals (as specified in product details).
  • Not use any of the Rentals for illegal or unsafe activities.

4.3. Delivery and pick up

The Rentals will be delivered and picked up at the address informed at the platform checkout page. Changes must be informed up to 48 hours by contact list available at the platform.

Failure to return the Rentals properly may result in additional fees.

5. Fees and Payments

5.1. Rental Fees

The rental fee is calculated based on the duration of use and any applicable pricing policies. The current fees for each type of Rental are displayed on the Platform and may be updated from time to time.

5.2. Payment Methods

Payments are made through the payment methods provided on the Platform. You authorize Tour Mobility Rentals to charge your payment method for all fees incurred, including rental charges, late fees, and damage costs.

5.3. Late Fees

If any Rental is not returned within the agreed rental period, additional late fees may apply following initial booking period, being considered as a new rental period.

5.4. Damage Waiver (Insurance)

Tour Mobility Rentals Damage Waiver (Insurance) covers losses, theft and damage out of your control when using the Rentals in accordance with local regulations and in a safe and appropriate manner.

6. User Responsibilities

You are responsible for:

  • The safe and responsible use of all Rentals (scooters, strollers, and cribs).
  • Any damages or loss of the Rentals during the rental period, including repairs or replacement (if not covered by Damage Waiver).
  • Any fines, penalties, or citations incurred during the rental period (if applicable).

You agree to return the rentals in the same condition as it was at the time of delivery.

You agree to pay the replacement costs associated with the loss, theft of or damage to any item. The payment used for the reservation will be charged on the final day of the service for any items that are not returned or returned damaged. If a form of payment is not available, an invoice will be sent, and payment is due on the same day. The replacement costs will be charged by market prices, plus taxes and fees (handling, shipping and services).

7. Cancellations

Tour Mobility Rentals requires all renters to agree to a 48-hour period cancellation/changes policy, which is based on the start date of the rental. Before the 48-hour period, we will reimburse 100% of the rental.

Any reservation that is cancelled/changed within that 48-hour time frame, regardless of the nature of the cancellation/change, will be subject to a one-day rental fee per item. The total amount of the "cancellation/change fee", is based on the type of equipment and how many pieces of equipment were booked. Partial reimbursement in this case will happen following this rule.

8. Limitation of Liability

The color and style of the Rentals may vary.

Tour Mobility Rentals is not liable for any injury, damage, or loss arising from the use of the Rentals, including but not limited to:

  • Accidents, personal injuries, or death.
  • Property damage.
  • Traffic violations or legal issues (related to scooters).

You accept full responsibility for any risks associated with the Rentals usage.

9. Termination of Service

Tour Mobility Rentals reserves the right to terminate or suspend your access to the Service at any time, without prior notice, if you violate these Terms of Use or engage in any unlawful activity.

10. Amendments

Tour Mobility Rentals reserves the right to modify these Terms of Use at any time. Any changes will be posted on the Platform, and continued use of the Service will constitute acceptance of the revised terms.

11. Governing Law

These Terms of Use are governed by and construed in accordance with the laws of United States. Any disputes arising from the use of the Service will be resolved in the courts of Florida State.
